Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by Thoughtfluence, Inc. (“Thoughtfluence,” “we,” “us,” or “our”), including our website at www.thoughtfluence.io, our embeddable widget, bio-link pages, dashboards, and APIs (collectively, the “Service”). By creating an account, embedding the widget, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Boilerplate notice. These Terms are a template aligned with the requirements of major OAuth providers and standard SaaS practice. They are not a substitute for advice from qualified counsel.

1. Eligibility

You must be at least 13 years old (or 16 if you reside in the European Economic Area, the United Kingdom, or Switzerland) and able to form a binding contract to use the Service. If you use the Service on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. The Service

Thoughtfluence helps creators consolidate their cross-platform presence and helps fans follow creators across platforms via two mechanisms: (a) OAuth one-click follows for platforms that explicitly authorize third-party follow actions through their official APIs, and (b) deep-links for platforms that do not. We do not, and will not, automate clicks or simulate user input on platforms that prohibit automation.

3. Accounts and Security

  • You are responsible for safeguarding your account credentials and for all activity under your account.
  • You agree to provide accurate information and to keep it current.
  • Notify us promptly at legal@thoughtfluence.io of any unauthorized use.

4. Subscription Plans and Billing

Some features of the Service are offered as paid subscriptions. Fees, billing cycles, and feature tiers are described at the point of purchase. Subscriptions renew automatically until cancelled. Except where required by law, fees are non-refundable. We may change pricing on at least 30 days’ notice; price changes do not apply retroactively to a current paid period.

5. Acceptable Use

You agree not to, and not to enable any third party to:

  • Use the Service to violate the terms of service or developer policies of any third-party platform, including by automating, scraping, simulating user input, or otherwise interacting with a platform in a manner that platform prohibits.
  • Use the Service to harass, defame, defraud, or impersonate any person, or to misrepresent your affiliation.
  • Upload or distribute malware, exploit, or otherwise interfere with the security or integrity of the Service.
  • Reverse-engineer, decompile, or attempt to extract source code from the Service, except to the extent expressly permitted by law.
  • Use the Service to send spam, unsolicited commercial messages, or content that infringes intellectual property rights.
  • Resell, sublicense, or commercially redistribute the Service without our prior written consent.

We may suspend or terminate accounts that violate this section, and we cooperate with platform partners on abuse investigations.

6. Third-Party Platforms

The Service interoperates with third-party platforms (Google/YouTube, Meta, Instagram, Threads, X, TikTok, Twitch, Spotify, Substack, Patreon, GitHub, Bluesky, Mastodon, LinkedIn, Snapchat, and others). Thoughtfluence is not affiliated with, endorsed by, or sponsored by any of these platforms. Your use of any third-party platform is governed by that platform’s own terms and privacy policies. We are not responsible for the actions, content, or availability of third-party platforms.

7. Your Content

You retain all rights in the content you submit to the Service (your handles, links, bio text, media, and any content imported from third-party platforms with your authorization). You grant Thoughtfluence a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, and create derivative works of your content solely as necessary to operate, provide, and improve the Service. You represent that you have the rights necessary to grant this license.

8. Intellectual Property

The Service, including all software, designs, text, graphics, logos, and trademarks (including “Thoughtfluence”), is owned by Thoughtfluence, Inc. or its licensors and is protected by intellectual property laws. Except for the limited license granted in these Terms, we reserve all rights.

9. Feedback

If you submit suggestions, ideas, or feedback, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction.

10. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the Service will be uninterrupted, error-free, or that follow actions on third-party platforms will succeed.

11. Limitation of Liability

To the maximum extent permitted by law, in no event will Thoughtfluence, Inc., its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to these Terms or the Service. Our aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the smallest amount permitted.

12. Indemnification

You agree to defend, indemnify, and hold harmless Thoughtfluence, Inc. from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms or any third-party rights.

13. Termination

You may terminate your account at any time by following the instructions at /deletion. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms, created risk for us or other users, or for legal compliance. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Subject to Section 15, the state and federal courts located in Delaware, USA have exclusive jurisdiction over any dispute not subject to arbitration.

15. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, except that you may bring qualifying claims in small-claims court. The seat of arbitration is Delaware, USA; arbitration may proceed by remote hearing where permitted. Class actions, collective actions, and class arbitrations are not permitted.

Opt-out: You may opt out of this arbitration agreement by sending written notice to legal@thoughtfluence.io within 30 days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you are opting out.

16. Changes

We may update these Terms from time to time. Material changes will be announced through the Service or by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

17. Miscellaneous

These Terms, together with the Privacy Policy and any plan-specific terms, constitute the entire agreement between you and Thoughtfluence, Inc. regarding the Service. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign them as part of a merger, acquisition, or sale of assets.
