Thoughtfluence respects the rights of creators and copyright owners. We respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. §512, and we expect our users to do the same.
1. Designated agent
Shared highlights (“marks”) also have a File a claim link on their page, which collects everything a notice needs and reaches the same agent.
2. Sending a notice of infringement
Your notice must be in writing and include all of the following (17 U.S.C. §512(c)(3)):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you say is infringed.
- Identification of the material you say is infringing, with enough information for us to locate it, such as its URL on www.thoughtfluence.io.
- Your contact information: name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
A notice that leaves out these elements may not be acted on. Knowingly misstating that material is infringing can make you liable for damages under 17 U.S.C. §512(f). If you are unsure whether a use is infringing (for example, whether it is fair use), consider asking a lawyer first.
3. What happens next
When we receive a complete notice we act expeditiously to remove or disable access to the material, make a reasonable effort to tell the person who posted it, and forward them a copy of the notice (with your contact details, so they can respond).
4. Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you may send our agent a counter-notice that includes (17 U.S.C. §512(g)(3)):
- Your physical or electronic signature.
- Identification of the material that was removed and where it appeared before it was removed.
- A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is (or, if outside the United States, any judicial district in which Thoughtfluence may be found), and that you will accept service of process from the person who sent the original notice or their agent.
We forward a valid counter-notice to the original complainant. Unless they tell us within 10 business days that they have filed a court action seeking to restrain the activity, we restore the material within 10 to 14 business days of receiving the counter-notice.
5. Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. An account that is the subject of repeated valid notices that are not successfully countered may lose the ability to share content or be closed.
6. Profiles of people
Some profiles on Thoughtfluence are built from public links and are not run by the person they describe; they are marked “Unclaimed”. To ask for one to be removed, use the removal request form. No account is needed.
